Auto dealer fraud

I got a car from dealer with clean title with no accident reported as per
CARFAX report. After 3 months my car got an accident and mechanic
discovered a serious damage which was not due to recent accident. That
damage was already there when I bought the car from dealer. The dealer
sold this car without fixing that serious damage which was not reprted in
carfax report. What should I do in this case.

It's your responsibility to have the car checked out before buying. If its had a certified inspection done on it before you purchased it has a warranty(that's usually put on a car at big dealerships) if not did you buy an extended warranty. check it in that way. They will want someone their useing to service it that will be in the contract. I hope everything works out for you. maybe if you have gap insurance on the car the wreck will total it out and the car will be paid for.

I agree with my responsibility to checked out before buying. I was buying from a dealer not a private party and he said that everything is fine. He told that there is no damages at present. But serious damage on body frame was discover by mechanic. I asked this thing to the dealer but he is not willing to answer. Although I doesn't have any gap insurance even then insurance company is not willing to pay saying that as old damage. They will be paying for recent damage. They have not titled it. What can I do to fix this situation ?
