Not everyone with recall issues can be expected to receive the notices or take care of the fix, which is nothing more than diagnostic software to alert the driver to the defective engine failing. Of course it's easier for some to blame the victim rather than the car manufacturer who put this unsafe, defective engine on the road after knowing it had issues.

You just said it, the low oil light was not on, and you had no oil due to not having the software updated. So regardless if you forgot to do it or didn't see the notice because it was lost in the mail, Hyundai Corporate is not legally bound to give you a new engine. They are calling the shots here regardless of what you think. If you think you are in the right, by saying that the engines were defective from the start, then I suggest you contact a lawyer to see if you have a case.

The software also, by the way, did not fix the defective engine, it merely was supposed to alert drivers if the defective engine problem manifested. So regardless if you forgot to do it or didn't see the notice because it was lost in the mail, Hyundai Corporate is responsible for producing the defective engine in the first place. Legal teams have already been on Hyundai for not disclosing this issue for years. So stop blaming the consumer.
