Response to earlier question

I had sent a question that was answered by James Sparrow about an
unauthorized credit report run by Mint Auto of Orlando.  The answer was that I
had apparently given my social security number to authorize the credit check.  
This is my response to Mr Sparrow’s answer.
I didn’t give them my social security number and I definitely didn’t give my
wife’s name and social security number.  They ran both of our credit reports.
The only thing I gave them was my name and address. I assume they used my
address and phone number.  I always stressed that the sale would be cash
only with no financing.  Needless to say I am disappointed in CarGurus for not
being aware of this type of thing happening and assuming that I am
responsible for Mint Auto’s fraudulent action. I think CarGurus should be
contacting Mint Auto about this situation. I still have not decided about legal
action as I still have all emails and texts to prove fraud. I would appreciate
hearing back from CarGurus as to what actions you might take.  
I have emailed Mint about this situation and as I assumed have not heard
anything back from them.

Cargurus is an advertising site only. They have no control over what their advertisers do, legally, or otherwise. You are welcomed to contact Cargurus Customer Service via email and see what they can do, if anything. Also remember that in order to take legal action against someone you must go to them. I would also suggest that you consider the cost and hassle of bringing action against the Dealer who may have pockets much deeper than yours. Lastly, you are correct, running a credit check without your consent is indeed illegal as far as I know. So, read every word of every document, both paper and electronic, and I bet somewhere in "the fine print" you inadvertently gave consent. Good luck to you.
